The $20 million lawsuit was filed in August of 2007 in a U.S. District Court in Texas, but is just now surfacing in media reports. According to Contact Music, James Martinez alleges that Tim lifted the song from a tape containing his song, "Anytime, Anywhere, Amanda." The audio was originally given to a team of songwriters who have also penned tracks for Tim’s 1997 album, Everywhere. The "Everywhere" single was written by Mike Reid and Craig Wiseman, who are also among the names listed in the lawsuit. Tim’s attorneys are confident the case will be dismissed, saying that Martinez’s accusations are "totally without merit."
