John Michael Asks for Lawsuit Dismissal

John Michael Montgomery has asked a judge in Lexington, Ky., to dismiss a slander lawsuit against him, arguing in court filings that statements he made to police qualify as “pure opinion” and cannot be found slanderous.

Lexington police office Joshua Cromer filed the suit last month, contending that John Michael made several false allegations against him to the police department’s internal affairs unit after Cromer arrested the singer on a DUI charge in January 2006. One of the allegations stated that Cromer took John Michael’s hat during the arrest. Cromer was dismissed from the Lexington police department after the incident, for postings he made on the MySpace website and for his actions in connection with the arrest. He is appealing the termination.
